This Privacy Policy describes the policies of Vulkan Creative Limited, 70 Mark Lane, London, EC3R 7NQ, United Kingdom of Great Britain and Northern Ireland, email: [email protected], phone: 020 3576 7525 on the collection, use and disclosure of your information that we collect when you use our website ( https://vulkancreative.com ). (the “Service”). By accessing or using the Service, you are consenting to the collection, use and disclosure of your information in accordance with this Privacy Policy. If you do not consent to the same, please do not access or use the Service.

We may modify this Privacy Policy at any time without any prior notice to you and will post the revised Privacy Policy on the Service. The revised Policy will be effective from when we publish it on this page, and your continued access or use of the Service after that will constitute your acceptance of the revised Privacy Policy. We therefore recommend that you periodically review this page.

  1. Information We Collect:

    We collect the following information about you:

    1. When you send an enquiry: your first and last name, your email address, your phone number if you give it, and, depending on the form, the services you are interested in, what you tell us about your project and your website address.
    2. When you sign up to our newsletter: your email address.
    3. With every form you send: how you found us, where the link you followed says so. This means the campaign tags in that link (such as utm_source and utm_campaign), ad click identifiers (gclid from Google Ads, fbclid from Meta and msclkid from Microsoft Ads), the page you first landed on, the website that sent you to us and the page you sent the form from. If you have accepted analytics cookies, this can include the same details from an earlier visit in the last 90 days, which we keep in a cookie called vc_attr (see our Cookie Policy).
    4. With every form you send: your IP address and browser details, which our form software records with each submission.
    5. If you accept cookies: information about how you use our website, as set out in our Cookie Policy.
  2. How We Use Your Information:

    We use the information we collect about you to:

    1. reply to your enquiry and talk to you about your project;
    2. send you our newsletter when we publish one, if you signed up for it;
    3. understand which pages, campaigns and adverts bring us enquiries, so we can improve them;
    4. measure how well our adverts on Google and Meta work;
    5. keep our forms free of spam and our website secure.

    UK data protection law requires us to have a lawful basis for each of these. We rely on:

    1. our legitimate interests, to reply to your enquiry and follow it up, to understand which pages, campaigns and adverts bring us enquiries, and to keep our forms free of spam and our website secure;
    2. your consent, for analytics and advertising cookies and for our newsletter. You can withdraw your consent at any time;
    3. a contract, where we go on to work together, to deliver the work and manage our relationship with you;
    4. legal obligations, to keep the business and tax records the law requires.

    If we want to use your information for any other purpose, we will ask you for consent and will use your information only on receiving your consent and then, only for the purpose(s) for which grant consent unless we are required to do otherwise by law.

  3. How We Share Your Information:

    We use the following service providers, who handle information for us:

    1. HubSpot, our customer relationship management system. It receives everything you send through our enquiry and newsletter forms, including the details of how you found us. If you accept analytics and advertising cookies, the HubSpot tracking code also records the pages you visit on our website and links them to your enquiry. Our HubSpot account is held in HubSpot’s EU data centre.
    2. Google. Google Workspace delivers our email, including the notification of your enquiry and our replies. Google Analytics measures visits to our website. Google Ads measures our adverts. reCAPTCHA checks form submissions for spam.
    3. Meta (Facebook and Instagram). If you accept advertising cookies, the Meta Pixel measures our adverts. When you send an enquiry, Meta learns that a form was sent and which form it was, not what you wrote in it.
    4. CookieYes, which provides our cookie banner and records your cookie choices.
    5. Hostinger, which hosts our website and stores the forms you send, and Cloudflare, which manages our domain and helps deliver the website.

    Some of these providers, including Google, Meta and HubSpot, may process information outside the United Kingdom. Where they do, the transfer is protected in one of the ways UK law allows: the destination is covered by UK adequacy regulations (these cover the European Economic Area and, for US companies certified under it, the UK Extension to the EU-US Data Privacy Framework), or the provider has signed the International Data Transfer Addendum to the standard contractual clauses.

    We require these providers to use the personal information we transfer to them only for the purpose for which it was transferred, and not to keep it for longer than that purpose needs.

    We may also disclose your personal information for the following: (1) to comply with applicable law, regulation, court order or other legal process; (2) to enforce your agreements with us, including this Privacy Policy; or (3) to respond to claims that your use of the Service violates any third-party rights. If the Service or our company is merged or acquired with another company, your information will be one of the assets that is transferred to the new owner.

  4. Retention Of Your Information:

    We keep your information only for as long as we need it. If your enquiry leads to work with us, we keep your details and our records of the work for six years after the work ends, for tax and legal reasons. If it does not, we keep your enquiry for up to three years after our last contact with you, in case you come back to us, and then delete it. If you sign up to our newsletter, we keep your email address until you unsubscribe or ask us to remove it.

    We may keep some information for longer where the law requires it, or where we need it to establish, exercise or defend legal claims. Anonymous and aggregated information, which does not identify you directly or indirectly, may be kept indefinitely.

    Google Analytics keeps the event data it collects about your visits for 14 months.

  5. Your Rights:

    Depending on the law that applies, you may have a right to access and rectify or erase your personal data or receive a copy of your personal data, restrict or object to the active processing of your data, ask us to share (port) your personal information to another entity, withdraw any consent you provided to us to process your data, a right to lodge a complaint with a statutory authority and such other rights as may be relevant under applicable laws. To exercise these rights, you can write to us at [email protected]. We will respond to your request in accordance with applicable law.

    You can change or withdraw your cookie consent at any time with the Cookie Settings link at the foot of every page.

    You may opt-out of direct marketing communications or the profiling we carry out for marketing purposes by writing to us at [email protected].

    Do note that if you do not allow us to collect or process the required personal information or withdraw the consent to process the same for the required purposes, you may not be able to access or use the services for which your information was sought.

  6. Cookies Etc.

    We use cookies and similar technologies only with your consent, except for those our website needs in order to work. Our Cookie Policy lists them, says what each one does and explains how to change your choice.

  7. Security:

    The security of your information is important to us and we will use reasonable security measures to prevent the loss, misuse or unauthorised alteration of your information under our control. However, given the inherent risks, we cannot guarantee absolute security and consequently, we cannot ensure or warrant the security of any information you transmit to us and you do so at your own risk.

  8. Questions and Complaints:

    If you have a question or a concern about how we handle your information, contact us at Vulkan Creative Limited, 70 Mark Lane, London, EC3R 7NQ, email: [email protected], phone: 020 3576 7525. We will address your concerns in accordance with applicable law. You can also complain to the Information Commissioner’s Office, the UK’s data protection regulator, at ico.org.uk.
